§ 1

GENERAL PROVISIONS

  1. The www.alexengineering.pl online store operates in accordance with these Terms and Conditions.
  2. The Terms and Conditions specify the terms of entering into and terminating Product Sales Agreements, complaint procedures, and the types and scope of services provided electronically by the www.alexengineering.pl Store, along with the conditions for entering into and terminating electronic service agreements.
  3. By using the Electronic Services of the Store www.alexengineering.pl, each Service Recipient is required to adhere to the provisions of these Terms and Conditions.
  4. Matters not covered by these Terms and Conditions are governed by applicable Polish law, including but not limited to:
  5. The Act on Electronic Services of 18 July 2002,
  6. The Consumer Rights Act of 30 May 2014,
  7. The Act on Out-of-Court Resolution of Consumer Disputes of 23 September 2016,
  8. The Civil Code Act of 23 April 1964.

§ 2

DEFINITIONS

  1. ORDER FORM – a form available on www.alexengineering.pl enabling an Order to be placed.
  2. CLIENT – a Service Recipient intending to enter into or has entered into a Sales Agreement with the Seller.
  3. CONSUMER – an individual entering into a legal transaction with an entrepreneur not directly related to their business or professional activities.
  4. ENTREPRENEUR – an individual, legal entity, or organizational unit without legal personality, granted legal capacity by law, conducting business or professional activities in their own name.
  5. PRODUCT – a tangible item available in the Store that is the subject of a Sales Agreement between the Client and the Seller.
  6. TERMS AND CONDITIONS – these terms and conditions of the Store.
  7. STORE – the online store operated by the Service Provider at www.alexengineering.pl.

  9. SALES AGREEMENT – a Product Sales Agreement entered into between the Client and the Seller via the Store.
  10. ORDER – a declaration of the Client’s will to enter into a Sales Agreement for the Product with the Seller.
  11. PRICE – the amount in currency the Client is obligated to pay the Seller for the Product.

§ 3

PRODUCT INFORMATION AND ORDERING

  1. The www.alexengineering.pl Store sells Products via the Internet.
  2. Products offered in the Store are new, compliant with the agreement, and have been legally introduced to the Polish market.
  3. Information on the Store’s website does not constitute an offer within the meaning of the law. By placing an Order, the Client submits an offer to purchase a specified Product under the terms outlined in its description.
  4. The Product Price displayed on the Store’s website is in Polish zloty (PLN) and includes all applicable components. Delivery costs are not included in the Price.
  5. Orders can be placed through the website using the Order Form (www.alexengineering.pl) 24 hours a day, year-round.
  6. To place an Order, the Client must review and accept the Terms and Conditions during the ordering process.

§ 4

CONCLUSION OF A SALES AGREEMENT

  1. To conclude a Sales Agreement, the Client must place an Order as specified in § 3, points 5 and 6 of the Terms and Conditions.
  2. Upon placing an Order, the Seller promptly confirms its receipt.
  3. The Client is bound by their Order once it has been confirmed as received by the Seller via email.
  4. The Order confirmation includes:
  5. all key elements of the Order,
  6. a withdrawal form,
  7. these Terms and Conditions, including information on the right to withdraw from the contract.
  8. Upon the Client’s receipt of the email specified in point 4, the Sales Agreement between the Client and the Seller is deemed concluded.
  9. Each Sales Agreement is confirmed with a purchase document attached to the Product.

§ 5

PAYMENT METHODS

  1. The Seller provides the following payment methods:
  2. traditional bank transfer to the Seller’s account,
  3. electronic payment system.
  4. In the case of traditional bank transfers, payment should be made to the following bank account: 63 1870 1045 2078 1081 4731 0001 (NestBank S.A.). The payment title should include “Order No. …”.
  5. For electronic payments, the Client completes payment before the Order is processed. The electronic system supports credit cards and instant bank transfers from select Polish banks.
  6. The Client must pay the Sale Price within 3 business days of concluding the Sales Agreement, unless stated otherwise.
  7. The Product will only be shipped after payment has been received.

§ 6

PRODUCT DELIVERY COSTS, TIME, AND METHODS

  1. The delivery costs, borne by the Client, are determined during the Order placement process.
  2. Delivery time consists of the Product’s preparation and carrier transit time:
  3. Product preparation time is up to 3 business days,
  4. Carrier delivery of tangible items is within up to 5 business days from dispatch (delivery only on business days, excluding Saturdays, Sundays, and holidays).
  5. Purchased Products are shipped only within Poland via InPost and within the European Union via DPD.

§ 7

PRODUCT COMPLAINTS

  1. Complaint due to Product non-compliance with the agreement.
  2. The basis and scope of the Seller’s responsibility to a Consumer for Product non-compliance are defined in the Consumer Rights Act of 30 May 2014.
  3. The basis and scope of the Seller’s responsibility to an Entrepreneur for warranty are defined in the Civil Code Act of 23 April 1964.
  4. The Seller is liable to a Consumer for Product non-compliance present at the time of delivery and revealed within 2 years, unless a longer validity period has been indicated.
  5. Notice of non-compliance and claims can be submitted via email to kontakt@alexengineering.pl or in writing to Technika Aleksander Ewich, ul. Julianowska 1/318, 91-473 Łódź.
  6. The complaint should contain details of the defect, date of its occurrence, and contact information.
  7. For product assessment, the Consumer must provide the Product to the Seller, who will arrange and cover the cost of return.
  8. The Seller will respond to the Client’s request within 14 days of complaint submission.
  9. If no response is provided within 14 days, the complaint is considered valid.
  10. In case of a valid complaint, the Seller will:
    a. cover repair or replacement costs, including return delivery,
    b. reduce the Product price proportionately and reimburse the Consumer within 14 days of receiving the price reduction statement,
    c. if the Consumer withdraws from the agreement, the Seller will refund the Product price within 14 days of receiving the Product or proof of its return.

§ 8

RIGHT TO WITHDRAW FROM THE AGREEMENT

  1. The Client who is also a Consumer may withdraw from a distance agreement without giving reasons by submitting a withdrawal statement within 14 days.
  2. In case of withdrawal, the Sales Agreement is considered null, and the Consumer must return the Product to the Seller or an authorized representative within 14 days of withdrawal, unless the Seller has arranged for its collection.

  4. The Consumer is responsible for any decrease in the Product’s value resulting from use beyond what is necessary to determine its nature, features, and functionality.

§ 9

OUT-OF-COURT COMPLAINT AND REDRESS METHODS

  1. Detailed information on the possibility for the Client who is a Consumer to use out-of-court complaint and redress methods, as well as the rules governing access to these procedures, are available on the website of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl.
  2. The Consumer may utilize the following methods of out-of-court complaint and redress:
  3. Mediation proceedings – the Consumer may request the initiation of mediation to resolve the dispute amicably with the Seller.
  4. Arbitration Court – the Consumer may also apply to a permanent consumer arbitration court, operating with the relevant Regional Inspectorate of Trade Inspection, for a resolution of the dispute.
  5. Online Dispute Resolution (ODR) platform – The Consumer has the option to submit a complaint via the EU ODR platform, available at http://ec.europa.eu/consumers/odr.

§ 10

PERSONAL DATA IN THE ONLINE STORE

  1. The Client’s personal data provided during the ordering process in the Store www.alexengineering.pl is processed by the Seller solely for the purpose of fulfilling the order and to enable the Client to exercise their rights related to the concluded Sales Agreement.
  2. The provision of personal data is voluntary; however, it is required for the performance of the Sales Agreement.
  3. The Client has the right to access their personal data, correct it, request its deletion, and limit its processing. Detailed information on personal data processing is available in the Store’s Privacy Policy.
  4. The Client may consent to receive commercial information electronically from the Store.

§ 11

FINAL PROVISIONS

  1. The Seller reserves the right to amend the Terms and Conditions for important reasons, including changes in law, modifications to payment and delivery methods, or technological advancements in the Store’s operations. The Client will be informed of any changes at least 7 days in advance through a notice on the Store’s website.
  2. Any changes to the Terms and Conditions do not affect Orders placed before the effective date of the amendments.
  3. In matters not covered by these Terms and Conditions, the applicable provisions of Polish law apply.
  4. Any disputes arising between the Seller and a Client who is a Consumer shall be resolved through negotiation in the first instance, with the intention of settling the dispute amicably.
  5. If the dispute cannot be resolved amicably, it shall be referred to the appropriate court for jurisdiction.

RETURN POLICY

you are not completely satisfied with your purchase for any reason, you may return it to

RETURNS

All returns must be postmarked within fourteen (14) days of the purchase date. All
returned items must be in new and unused condition, with all original tags and labels
attached.

RETURN PROCESS

To return an item, please email customer service at kontakt@alexengineering.pl to
obtain a Return Merchandise Authorisation (RMA) number. After receiving a RMA
number, place the item securely in its original packaging and the return form provided,

REFUNDS

After receiving your return and inspecting the condition of your item, we will process
your return. Please allow at least seven (7) days from the receipt of your item to
process your return. Refunds may take 1-2 billing cycles to appear on your credit card
statement, depending on your credit card company. We will notify you by email when
your return has been processed.

WARRANTY CONDITIONS FOR ALEXENGINEERING.PL ONLINE STORE

  1. Scope of Warranty
    AlexEngineering grants a 12-month warranty on all products sold in our online store. The warranty covers
    defects in materials or workmanship that occur during normal use of the products.
  2. Warranty Period
    The warranty is valid for 12 months from the date of purchase, as confirmed by the receipt or invoice.
  3. Reporting Defects
    In the event of a defect, the customer has the right to file a complaint within 14 days of discovering the defect. Complaints should be submitted via email to: kontakt@alexengineering.pl or by phone at: +48 789569429.
  4. Complaint Procedure
    Customers should provide the following information in their complaint submission:
    – Name and contact details.
    – Order number and purchase date.
    – Description of the defect and the circumstances of its occurrence.
    – Preferred resolution method (repair, replacement, refund).
  5. Complaint Handling
    Complaints will be processed within 14 business days from the date of submission. If the complaint is accepted, the store commits to:
    – Repairing the product.
    – Replacing the product with a new one if repair is not possible.
    – Refunding the purchase price or reducing the product price.
  6. Complaint Costs
    In the case of an accepted complaint, the store will cover the shipping costs related to returning the
    defective product and sending back the repaired or replaced product.
  7. Warranty Exclusions
    The warranty does not cover:
    – Damage caused by improper use, including mechanical damage, water damage, or other external
    influences.
    – Normal wear and tear of the product.
    – Modifications made to the product by the customer.
  8. Final Provisions
    Warranty conditions may be updated. Customers will be informed of any changes on the store’s website. This warranty does not exclude, limit, or suspend the customer’s rights arising from legal regulations, including rights under statutory liability for defects.
